POPIA Privacy Notice

This POPIA Privacy Notice explains how SP-Energy processes personal information. It is issued in terms of the Protection of Personal Information Act 4 of 2013 (POPIA). SP-Energy is a South African solar equipment supplier and installation company based in Vanderbijlpark, Gauteng, trading since 2013.

We supply hybrid inverters, off-grid inverters, three-phase inverters, lithium batteries, solar panels, charge controllers and solar air conditioners from brands such as Deye, Luxpower, Dyness, Greenrich, JA Solar and Jinko. We also design, size and install complete solar systems for homes, businesses, farms and commercial properties. Each of those activities involves some personal information, and this notice sets out how we handle it.

Responsible Party And Information Officer

The responsible party is Solar Panel Energy (Pty) Ltd, registration number 2019/066312/07, trading as SP-Energy from 204 Louis Trichardt Blvd, S. E. 1, Vanderbijlpark, 1911, South Africa.

Personal Information We Collect

We collect only what we need to quote, supply, deliver and support solar equipment.

  • Name, surname and company name
  • Email address, phone number and WhatsApp number
  • Delivery address, collection branch and site address
  • Order details, invoice records and proof of payment
  • VAT and company registration details for business customers
  • Site assessment notes, roof details, electricity usage and load requirements
  • Product serial numbers for battery and inverter warranty claims
  • Website usage data collected through cookies and analytics tools

We do not knowingly collect information from children, and we do not collect special personal information as defined in POPIA.

Purpose And Lawful Basis

Every processing activity has a defined purpose and a lawful basis under section 11 of POPIA.

  • Contract performance: preparing quotations, processing orders, arranging courier delivery through The Courier Guy, and scheduling installations
  • Legal obligation: keeping tax invoices and VAT records as required by South African law
  • Legitimate interest: system sizing advice, technical support, warranty administration and fraud prevention
  • Consent: marketing emails, newsletters and promotional messages, which you may withdraw at any time

Site assessment details, for example your daily load profile or which battery suits a Luxpower inverter, are used solely to size a system correctly.

Who We Share Information With

We share personal information only where it is necessary to complete your order or meet a legal duty. Recipients include our courier for delivery, payment providers processing EFT, card and PayFast transactions, and manufacturers or distributors handling a warranty claim. Installers appointed for your project receive your site address and contact details. Our hosting, email and accounting providers process information on our instruction as operators under written agreement.

We do not sell personal information. Where an operator is located outside South Africa, we confirm that comparable protection applies as required by section 72 of POPIA.

How We Secure Your Information

Our website runs over HTTPS with a security firewall and regular backups. Access to customer records is limited to staff who need it, and accounts are password protected. Paper quotations and invoices are stored securely at our Vanderbijlpark office. We keep records for as long as the law requires, then delete or de-identify them. If a security compromise occurs, we notify affected data subjects and the Information Regulator as required.

Your Rights Under POPIA

  • Request access to the personal information we hold about you
  • Ask us to correct or delete information that is inaccurate or outdated
  • Object to processing based on legitimate interest
  • Withdraw consent for direct marketing at any time
  • Ask which third parties have received your information
  • Lodge a complaint with the Information Regulator

Access requests may be submitted using Form 2 under the Promotion of Access to Information Act. Send it to inquiry@sp-energy.co.za and we will respond within the statutory period.

Unresolved POPIA complaints may be referred to the Information Regulator of South Africa at enquiries@inforegulator.org.za. Our office hours are Monday to Friday, 08:00 to 17:00, and Saturday, 08:00 to 12:00.
