POPIA Privacy Notice

This privacy notice explains how SP-Energy processes your personal details under South African privacy law. Homeowners, business owners, farm owners and solar installers can see what we collect, why, and how to object. Processing simply means collecting, storing, using or sharing information. SP-Energy supplies and installs solar equipment from its head office in Vanderbijlpark, Gauteng.

Responsible Party and Information Officer

The responsible party is Solar Panel Energy (Pty) Ltd, registration number 2019/066312/07, trading online as SP-Energy. Responsible party means the business that decides why and how your details are used. E Oosthuizen is our Information Officer, the person who handles every privacy request.

Personal Information We Collect

Most details come from you when you ask for a quote, order or book a site visit.

  • Identity and contact details: name, phone number, email address and WhatsApp number.
  • Site and delivery details: physical address and system needs for quotes or installations.
  • Order and payment records: invoices, products bought and proof of payment.
  • Business details: company name and VAT number for installers and resellers.
  • Website data: device type, pages viewed and cookies.

We avoid collecting special personal information, such as health or religious details. Our website cookie policy explains which cookies run on the site and how to block them.

Why We Use Your Details

The law lets us process details only for a clear reason, called a lawful basis.

  • Contract: preparing quotes, processing orders, arranging delivery and handling warranty claims.
  • Legal duty: keeping invoices and tax records that SARS requires.
  • Legitimate interest: answering questions and keeping systems and payments secure.
  • Consent: sending offers and product news, which you can stop at any time.

Your POPIA consent for marketing can be withdrawn by emailing inquiry@sp-energy.co.za.

Who Receives Your Information

SP-Energy never sells or rents your details to anyone. Only parties needed to complete your order receive them.

  • Courier partners, for nationwide delivery in 2 to 5 working days.
  • PayFast and our bank, for online and EFT payments.
  • Brand suppliers, when a warranty claim needs a serial number.
  • SARS and other authorities, when the law requires it.

Each party may use your details only for that task.

How We Keep Your Data Safe

Access to client records is limited to staff who need them for your order. Records are stored securely, and old quote details are deleted once no longer needed. Invoices and tax records are kept for at least 5 years, as tax law requires. If a data breach affects you, we will tell you and the Information Regulator.

Your Rights as a Data Subject

Data subject means you, the person the information is about. What does POPI Act stand for? It means the Protection of Personal Information Act, which sets rules for handling personal details.

Government publishes the official text of the POPI Act 4 of 2013 online.

Who does the POPI Act apply to? Every business in South Africa that keeps client records must follow it, including SP-Energy.

Under the POPI Act in South Africa, you can do the following.

  • Ask what details we hold about you and who received them.
  • Correct details that are wrong, incomplete or out of date.
  • Request deletion of details we no longer need.
  • Object to processing, including direct marketing, at any time.
  • Complain to the Information Regulator if we do not resolve your concern.

PAIA is the Promotion of Access to Information Act, which covers requests for records. Requests for company records follow the steps in our PAIA access manual.
