PAIA Access Manual

This PAIA Access Manual is published in terms of section 51 of the Promotion of Access to Information Act 2 of 2000 (PAIA). It explains what records Solar Panel Energy (Pty) Ltd holds, and how you may request access to them.

We are a private body as defined in PAIA. The Act gives effect to the constitutional right of access to information held by private bodies, where that record is required to exercise or protect a right. This manual sets out the procedure, the categories of records we keep, and the remedies available to you if a request is refused.

SP-Energy has supplied and installed solar equipment across South Africa since 2013. We stock hybrid inverters, off-grid inverters, three-phase inverters, lithium batteries, solar panels, charge controllers and solar air conditioners from brands such as Deye, Luxpower, Dyness, Greenrich, JA Solar and Jinko. Our records reflect that trading activity.

Information Officer

The Information Officer is E Oosthuizen. All PAIA requests, queries and follow-ups must be directed to the Information Officer at inquiry@sp-energy.co.za, or by post to the Vanderbijlpark address above. Requests may also be discussed by phone on +27 74 305 2967 during office hours, which are Monday to Friday, 08:00 to 17:00, and Saturday, 08:00 to 12:00. No Deputy Information Officer has been appointed.

How To Request Access To A Record

Follow the prescribed procedure below.

  • Complete the prescribed request form issued under PAIA, available from the Information Regulator of South Africa
  • Send the completed form to inquiry@sp-energy.co.za or deliver it to our Vanderbijlpark office
  • State clearly which record you need, and provide enough detail for us to identify it
  • State the right you are seeking to exercise or protect, and explain how the record will assist
  • Provide your full name, identity number, postal address, email address and contact number
  • State the form of access you prefer, such as a copy, an inspection, or an electronic file
  • Pay the prescribed request fee and any access fee, where these apply

We acknowledge receipt within 2 working days. A decision is given in writing within 30 days of receiving a valid request, as required by PAIA. That period may be extended in the circumstances permitted by the Act, and we will notify you if it is.

Categories Of Records Held

Records are kept in electronic and paper form. Not every record is automatically available, and each request is assessed individually.

  • Company records: registration documents, memorandum of incorporation, statutory registers
  • Financial records: invoices, quotations, proof of payment, bank records, audited statements
  • Tax records: VAT returns, PAYE records and other SARS submissions
  • Customer records: orders, delivery details, site assessments and system sizing notes
  • Product and warranty records: serial numbers, warranty claims and supplier correspondence
  • Supplier records: distributor agreements and purchase orders for brands we stock
  • Installation records: site visit notes, project files and workmanship warranty documents
  • Employment records: contracts, payroll and leave records
  • Marketing records: website content, campaign data and analytics reports

For example, a customer file may include the quotation for a Luxpower inverter and battery, the delivery note, and the invoice used for a later warranty claim.

Records Available Under Other Legislation

Certain records are available under other South African laws without a PAIA request. These include records kept in terms of the Companies Act 71 of 2008, the Value-Added Tax Act 89 of 1991, the Income Tax Act 58 of 1962, the Basic Conditions of Employment Act 75 of 1997, the Labour Relations Act 66 of 1995, the Consumer Protection Act 68 of 2008, and the Electronic Communications and Transactions Act 25 of 2002. Personal information is also handled in terms of POPIA, as set out in our POPIA Privacy Notice.

Grounds For Refusing Access

Access may be refused on the grounds set out in Chapter 4 of PAIA.

  • Unreasonable disclosure of the personal information of a third party
  • Commercial information of a third party, including trade secrets and supplier pricing
  • Information supplied in confidence
  • Records protected by legal professional privilege
  • Our own commercial information, research and pricing structures
  • Records that could endanger the safety of a person or property
  • Requests that are manifestly frivolous or vexatious

Where part of a record may be refused, we release the remainder if it can reasonably be separated.

Remedies If Access Is Refused

If your request is refused, or you are unhappy with the decision, you may lodge a complaint with the Information Regulator of South Africa at enquiries@inforegulator.org.za. You may also apply to a court of competent jurisdiction for relief. There is no internal appeal procedure for a private body under PAIA.
